Welcome to the website of SonicLiving, Inc. (“SonicLiving”, “we” or “us”). This Privacy Policy sets out our policy relating to the use and access of SonicLiving.com (the "Website") and the SonicLiving iTunes Scanning Application (the "Software" and together with the Website, Widgets and any other related SonicLiving services, the "Service") by Website visitors and users of the Service (“you”). This Privacy Policy should be read and agreed to alongside the SonicLiving Terms of Service at http://sonicliving.com/terms (which together govern your use of the Service) before accessing the Service. The Service requires a certain amount of your precious information in order for you to fully take advantage of our Service's magic. We take care to refrain from asking for any more information than we need in order to give you the best experience with the Service.

  1. Personal Information. SonicLiving collects certain personally-identifiable data (“personal information”) as a condition of using and accessing the Service. This may include your name and email address. SonicLiving will provide you with access to your personal information in order to update or correct information you have provided. We also collect personal information when you use certain features of the Service, contact us with questions or comments, or respond to one of our surveys. We and our affiliates and subsidiaries may also use your personal information collected through the Service to help us improve the content and functionality of the Service, to better understand our users and to improve the Service. By voluntarily providing us with personal information, you are consenting to our use of it in accordance with this Privacy Policy. If you provide personal information, you acknowledge and agree that such personal information may be transferred from your current location to the offices and servers of SonicLiving and the authorized third parties referred to in this Privacy Policy located in the United States. Below are some more specific details about what we'll ask for and how we’ll use it:
    1. First and Last Name. At this point, you can make these up. We don't really care what you call yourself. However, please note that this may change. It is your responsibility to monitor changes in this Privacy Policy and the Terms of Service, which may happen at any time.
    2. Email address. SonicLiving requires a valid email address in order for us to communicate with you, send you show notifications and let you know about special offers that you can opt out of in your Mail Preferences. If at any time you wish not to receive any future special offers or you want to have your name deleted from our mailing lists, you can also contact us at our email address below. Note however that you can’t opt-out of some administrative communications that are reasonably necessary to the Service, such as service notifications.
    3. Zip Code/ Town/ Location. SonicLiving needs to know where you are, so that we know where you want to see shows. You can add as many regions as you like, and we’ll use the locations you give us to send you notifications about events in those areas.
    4. Your iTunes Music Listening Information. The Software collects artist information from your iTunes library, which we then use to send you show alerts based on your personal taste.
    5. Pandora®, Last.fm and Other Music Services Information. You can opt in to SonicLiving's music scans, which look at and collect information about your listening habits on certain third party services and use that information to provide you with matching events on the Service that you might like to see. We do not ask for your passwords to these services. Please be sure to read the Terms of Service and Privacy Policies of the applicable third party service, as SonicLiving is not responsible for the privacy practices of other websites or services.   2. Cookies. SonicLiving requires the use of cookies to operate at its best. If your browser is set to reject cookies (see the Help menu), you may have trouble using the Service or you may not be able to use certain features of the Service at all. We use cookies so we know who you are when you come back to the Website (so you don’t have to log in every time you visit) and so we can keep track of your previous activity on the Website. If you don't accept cookies from our Website, you can still browse around the shows, but you won't get the full personalized experience of the Service. Cookies are both helpful and delicious, but you can choose to disable them if you want.   3. Other Information. SonicLiving uses the personal information that you willingly provide so that we know who you are, can track your listening habits, recognize you when you visit and provide you with relevant show info. In addition, SonicLiving and our affiliates and subsidiaries may use and collect certain non-personally identifiable information (often from cookies as described above), such as browser-related information, your IP Address, requested URLs, referring URLs, and timestamp data to know what browser and operating system you are using and where you access the Service from so that we can analyze Service data, make improvements to the Service, and provide an optimal level of service in all geographical areas. We may store such information itself or such information may be included in databases owned and maintained by our affiliates, agents or service providers.
  4. Links. SonicLiving contains links to other websites, but those links don’t imply that we’ve reviewed or that we endorse those other websites. We are not responsible for the content or Privacy Policies of other websites. This Privacy Policy applies only to information gathered and used by SonicLiving. Please be careful when using the interwebs.
  5. Sharing Information. SonicLiving partners with third party service providers such as ticket vendors and other websites like Pandora, to perform business-related functions. We may share your demographic information with our partners. This information will not be linked to any personal data but may include information such as zip codes, ticket-purchasing habits, and music-listening habits. We may need to share this information with our partners in order to provide the services that they offer in connection with the Service. Also, we sometimes conduct research on our customer demographics, interests and behavior based on the personal information and other information provided to us. This research may be compiled and analyzed on an aggregate basis. We may share this non-identifiable and aggregate data with our subsidiaries, affiliates, agents and business partners, but this type of non-identifiable and aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our Service to current and prospective business partners, and to other third parties for other lawful purposes. Also, if you enter a contest or giveaway with SonicLiving, or RSVP to an event, we may share your email address or name with the artist or entity (and their representatives) sponsoring the contest or putting on the event (see the Widget section below for more on this). In the event of a corporate sale, merger, reorganization, dissolution, acquisition or other similar event, your data may be part of the transferred assets. Finally, we may disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend the rights or property of SonicLiving, act in urgent circumstances to protect the personal safety of users of the Service or the public, or protect against legal liability.
  6. Contact Importing. SonicLiving offers a convenient way to tell your friends on other social networks about the Service, including but not limited to, MySpace, Facebook and various email applications (“Friend Invite”). SonicLiving may ask you for your login information for other websites and services and the email addresses of your friends. All information you give to SonicLiving through our Friend Invite is kept private and will not be re-used for any purpose other than the following:
    1. If you elect to remind your friends 3 days after your initial invite, SonicLiving will use the contact information you provided in your initial contact import to send them a reminder.
    2. We will also store their information in our database so that we can tell you when your friend has signed up.   7. Integrating Third Party Services. One of the very magical features of the Service is that it allows you to enable certain online third party services, like social media and social networking services (“Third Party Services”), to be directly integrated into your SonicLiving experience. By directly integrating these services, we make your online experience richer, and more personalized (for example, by allowing you to RSVP to events). To take advantage of this feature, we will ask you to enter your username and password for the relevant Third Party Services, but we do not collect or store your password. By enabling Third Party Services, you’re allowing us to pass your log-in information to these service providers for this purpose. When you add a Third Party Service account to the Service, we will collect your login information and other relevant information necessary to enable the Service to access that Third Party Service and your data contained within that Third Party Service. We will receive the personal information and other data that you have previously indicated may be passed from these Third Party Services. However, please remember that the manner in which Third Party Services use, store and disclose your information is governed solely by the policies of such third parties, and we will have no liability or responsibility for the privacy practices or other actions of any Third Party Service that may be enabled within the Service.
  8. Widgets. Our Service and data collection devices include “Widgets,” which are interactive mini-programs that run on the websites of event organizers, artists and other entities to provide specific services (e.g. RSVP’ing to an event) and may be integrated with Third Party Services. Personal information, such as your profile image, name and email address, may be passed from Third Party Services through the Widget if you’ve permitted the Third Party Service to do so. Cookies may also be set by the Widget to enable it to function properly. SonicLiving is the data processor of the personal information collected through these Widgets when the Widgets are on a third party’s site. However, because the third party is actually the controller of this data, you should also refer to their privacy policy.
  9. Kids. SonicLiving does not knowingly collect personal information from children under the age of 13. No offense, but if you are under the age of 13, please do not submit any personal information through the Service. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal information to the Service without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to us through the Service, please contact us, and we’ll endeavor to delete that information from our databases.
  10. Security. We take reasonable steps to protect the personal information provided via the Service from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no internet, email or other electronic transmission is ever fully secure or error free, so you should take special care in deciding what information you send to us in this way.
  11. Exclusions. This Privacy Policy doesn’t apply to any personal information collected by SonicLiving other than personal information collected through the Service. This Privacy Policy doesn’t apply to any unsolicited information you provide to us through the Website or through any other means such as forums, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information will be deemed to be non-confidential and we’re free to exploit that Unsolicited Information without limitation or attribution.
  12. Changes to this Privacy Policy. SonicLiving reserves the right to make changes to this Privacy Policy without prior notice. This Privacy Policy was last updated on the date indicated above. Your continued use of the Service after any changes or revisions to this Privacy Policy indicates your agreement with the terms of the revised Privacy Policy.
