CC didn't include Insecticon on their album because they couldn't find Lo-bat to ask permission. It's explained in this interview which came out 1 year before nerds started bitching about the Lo-bat sample:

yea it was about 40 minutes. I think dd/mm/yyyy played longer than they did. wah. ammon s: those aren't Crystal Castles tracks. They are tracks from a band called Lo Bat that CC sampled heavily for their Insecticon song. There's been some controversy of whether or not it violates the Creative Commons license that Lo Bat is protected under. If you hear the track "My Little Droid Needs A Hand" and compare it to "Insecticon", you'll hear the difference, and the similarity.
